Para pembuat kebijakan di Indonesia sedang mempertimbangkan merelokasi pelabuhan masuk impor untuk tujuh komoditas, yakni tekstil, garmen, keramik, alas kaki, pakaian, kosmetik, dan elektronik, ke pelabuhan timur di Sorong, Papua Barat, Bitung, Sulawesi Utara, dan Tenau Kupang, Nusa Tenggara Timur. Relokasi ini direncanakan setelah pelonggaran perizinan impor terhadap tujuh komoditas berdasarkan Peraturan Menteri Perdagangan 48/2024, yang antara lain mengesampingkan pertimbangan teknis sebagai persyaratan untuk memperoleh izin impor.
Jika dilaksanakan, pemindahan ini akan menjadi jalan pintas kebijakan untuk mengurangi impor dan membantu industri dalam negeri bersaing. Pemindahan impor ke pelabuhan yang lebih jauh akan meningkatkan biaya logistik dan harga eceran, sehingga memberikan keunggulan harga yang kompetitif bagi produk lokal. Namun, hal ini berpotensi melanggar aturan multilateral berdasarkan Perjanjian Umum tentang Tarif dan Perdagangan (GATT) 1994.
Saat ini, 75 persen impor nonmigas Indonesia ditangani di Pulau Jawa di wilayah barat Indonesia, melalui pelabuhan-pelabuhan utama Tanjung Priok (Jakarta), Tanjung Emas (Semarang, Jawa Tengah), dan Tanjung Perak (Surabaya, Jawa Timur). Jawa, yang dihuni oleh 156,9 juta jiwa – 55 persen dari populasi Indonesia – menjadi tempat tinggal mayoritas konsumen dan pusat distribusi barang impor. Sisanya, 45 persen, tersebar di pulau-pulau lain di wilayah barat, tengah, dan timur.
Saat ini, Tanjung Priok merupakan pelabuhan impor terbesar untuk tujuh komoditas yang dimaksud. Misalnya, pada tahun 2023, pelabuhan tersebut menangani impor alas kaki senilai $616,4 juta, atau 64 persen dari total impor alas kaki nasional sebesar $968,8 juta.
Sebaliknya, kegiatan impor di Papua Barat, Sulawesi Utara, dan Nusa Tenggara Timur tergolong kecil, yakni masing-masing sebesar 0,02 persen, 0,05 persen, dan 0,02 persen dari total impor Indonesia. SorongBahasa Indonesia: BitungDan Tenau Kupang pelabuhan tidak menangani impor tujuh komoditas yang ditandai dalam kebijakan baru.
Importir akan menanggung biaya lebih tinggi jika harus mengangkut barang dari negara asal ke pelabuhan di timur dan kemudian ke Jawa. Jarak laut dari Sorong ke Jakarta, misalnya, adalah 3.935 kilometer, dan kapal-kapal transit melalui Makassar di Sulawesi dan Surabaya. Dengan demikian, pemindahan pelabuhan masuk menciptakan hambatan bagi impor dan akan meningkatkan daya saing harga produk lokal.
Memang, impor tujuh komoditas telah melonjak dan menenggelamkan industri lokal. Impor yang paling mengganggu adalah barang-barang yang dijual dengan harga di bawah normal. dari Cinasementara barang impor dari negara lain pada umumnya diperdagangkan dengan harga pasar standar.
Terlebih lagi, impor ilegal sudah tidak terkendali, sehingga memperburuk kerugian yang dialami industri dalam negeri. Pada bulan Oktober 2015, Presiden Joko Widodo dideklarasikan bahwa ia telah memerintahkan dinas bea cukai untuk menyelidiki impor ilegal. Ia mengumumkan bahwa perintah tersebut telah dilaksanakan dengan benar, dan kegiatan impor ilegal telah dikekang.
Namun sembilan tahun kemudian, tepatnya pada bulan Juli 2024, satuan tugas antar kementerian dan lembaga dibentuk. didirikan untuk mengatasi maraknya barang impor murah dan ilegal. Satgas telah mengerahkan kekuatannya dengan menutup gudang, menyita, dan memusnahkan barang-barang ilegal tersebut.
Kini Indonesia tengah mempertimbangkan pendekatan baru. Pemindahan pelabuhan masuk akan berdampak pada kenaikan harga dan pengurangan pasokan barang dari semua negara, sehingga menguntungkan produsen lokal. Namun, perubahan tersebut juga akan membatasi pilihan konsumen dan memaksa mereka membeli produk lokal yang mungkin tidak selalu sesuai dengan preferensi mereka.
Relokasi pelabuhan merupakan tindakan perdagangan, dan dengan demikian kesesuaiannya dengan aturan multilateral harus dipertimbangkan. Pasal XI:1 GATT 1994 (Penghapusan Umum Pembatasan Kuantitatif) melarang “larangan atau pembatasan selain bea, pajak, atau biaya lain, baik yang diberlakukan melalui kuota, lisensi impor atau ekspor, atau tindakan lain.” Panel dalam penyelesaian sengketa Organisasi Perdagangan Dunia yang relevan telah menafsirkan “tindakan lain” mencakup “kategori residual yang luas” yang memengaruhi daya saing barang.
Pemindahan pelabuhan yang dipaksakan menyiratkan pembatasan jumlah pelabuhan yang tersedia untuk impor. Kasus Kolombia-Panama dalam mekanisme penyelesaian sengketa WTO (Bahasa Indonesia: DS366) selama tahun 2007-2009 berfungsi sebagai referensi untuk menentukan apakah tindakan tersebut merupakan pembatasan impor.
Dalam kasus tersebut, Kolombia melarang impor tekstil, alas kaki, dan pakaian dari Panama atau Zona Bebas Colon (Bahasa Inggris CFZ), kecuali untuk impor yang dikirim ke bandara Bogota dan pelabuhan laut Barranquilla. Panama berpendapat bahwa pembatasan pelabuhan tersebut memberlakukan kondisi yang membatasi karena hanya ada dua pelabuhan masuk, dari total 11 pelabuhan, yang tersedia. Panama mengatakan bahwa pembatasan tersebut membatasi persaingan dengan memaksa importir menanggung biaya pengiriman yang lebih tinggi untuk mencapai pasar utama di luar Bogota dan Barranquilla, sehingga menghambat ekspor dan menciptakan ketidakpastian, sehingga pembatasan tersebut melanggar Pasal XI:1 GATT.
Pada tanggal 20 Mei 2009, Badan Penyelesaian Sengketa WTO mengadopsi laporan panelBahasa Indonesia: yang antara lain menilai bahwa pembatasan pelabuhan Kolombia merupakan pembatasan impor yang dilarang. Pembatasan pelabuhan, meskipun bukan kuota atau izin impor, dapat dianggap sebagai salah satu “tindakan lain” yang dilarang oleh Pasal XI:1.
Meskipun larangan pelabuhan Kolombia diterapkan secara diskriminatif terhadap impor hanya dari Panama atau CFZ, panel menilai bahwa tindakan tersebut, baik diskriminatif atau tidak, melanggar Pasal XI:1. Hal ini dapat menjadi preseden jika Indonesia memberlakukan pembatasan pelabuhan, meskipun tidak ditujukan pada negara tertentu, dan tindakan tersebut ditentang di WTO.
Para pembuat kebijakan Indonesia perlu secara hati-hati mempertimbangkan manfaat ekonomi dari mendukung industri lokal dengan biaya pembatasan pilihan konsumen dan risiko ketidakpatuhan terhadap aturan perdagangan multilateral.
